Case Spotlight #2

In a child abduction case involving 3 Mexican born children, a New York federal court judge has ruled that the children can remain in the United States, along with their mother, who fled Mexico in 2010 seeking to hide from allegedly abusive husband.

In so ruling, the court noted that the oldest child was now beyond the reach of the Hague Convention, which only applies to children under 16 years of age, and to order the two younger children back to Mexico at this time would "further fracture the family unit".

A father successfully modified an order of joint legal custody to sole custody after the children's mother demeaned and disparaged her 10 year old son in Facebook posts.

After issuing an order of protection, barring the mother from mentioning her children in any of the social media forums, the court stated, "There was sufficient evidence regarding the mother's inappropriate use of the internet to demean and disparage the oldest child, as well as her lack of remorse or insight onto the inappropriateness of such behavior, so as to justify the court's issuance of the order of protection."

A jury has found NYPD Officer, Gilberto Valle, guilty of conspiring to cannibalize, kidnap and torture women.
The jury also found Valle guilty of accessing a federal law enforcement database and using it to research potential victims. Valle could be sentenced to life in prison for one count of kidnapping conspiracy. He could also face up to five years in prison for illegally accessing the federal law enforcement database.
The NY Times reported Prosecutor Hadassa Waxman told the jury earlier last week, “The evidence proves beyond a reasonable doubt that Officer Valle’s plans were real, that he was serious, that he was not just entertaining himself. He would have carried out a plan if he thought he could get away with it.”
According to the Huffington Post, Valle's wife is the one who tipped the cops off of her husband’s plans. Would you have made the same decision? Would a divorce have been easier? Let us know your thoughts.
